Almost all unsecured debts can be included in bankruptcy. These include:
Credit cards
Personal loans
Bank overdrafts
Store cards
Catalogue debts
Debts to HM Revenue and customs such as income tax.
However, there are some specific debts which cannot be included in bankruptcy:
Secured Debt
Mortgages and secured loans cannot be included in bankruptcy and must continue to be paid. If it is your intention to allow the property to be repossessed, then once the keys are handed back to the mortgage lender, any mortgage or secured loan shortfall will then be included in the bankruptcy procedure.
Student Loan
Company loans
Although they are not secured, Student Loan
Company loans are exempt from the effects of bankruptcy. As such, you will remain fully liable for such loans even after you have been discharged from your bankruptcy.
Child Support Agency Debt
Arrears to the CSA cannot be included in bankruptcy and will not be written off by the bankruptcy process.
